Transgender Partner: Hc Allows Woman To Live With Transgender Partner | Jaipur News
JAIPUR: A division bench of Rajasthan High Court on Monday has allowed a 22-year-old woman to live with the 34-year-old transgender under police protection as per her choice. The bench comprising Justice Pankaj Bhandari and Justice Bhuwan Goyal ordered this on Monday while hearing the habeas corpus petition filed by the transgender.
Naman Maheshwari, counsel for the petitioner, sharing the details of the case, said, “The petitioner stated that her partner has been illegally confined by her parents at their residence at Sawai Madhopur district since October 2023 with the active support of the police.We told the petitioner and the detainee woman that they wish to live their life together. However, the parents of the woman rejected his plea since he is a transgender.”
“On October 11, 2023, the woman tried to elope with the petitioner. However, with the support of police, the family of the woman separated the couple. Also, the woman was held captive and forced to get married by her family members. We have also maintained that the woman had even attempted suicide by ingesting sleeping pills, but survived,” said Maheshwari.
Also, FIR was lodged against the petitioner and on October 14, the petitioner and woman were recovered from Gujarat. “During the recording of the statement that woman had told the police that she wanted to live with the transgender. So, it is her will to live with the transgender and she should be allowed,” he added.
The high court on January 3 had directed the government to produce the woman on January 8. “The woman after being asked clearly replied that she wanted to live with the petitioner.” Hearing the arguments, the high court directed that the woman should be taken to the place of her choice, under police protection and its compliance should be done.
